FSLA REMINDER: MAKE SURE TO UPDATE VISITATION POLICIES TO COMPLY WITH AHCA EMERGENCY RULES ON VACCINATIONS & MASKS

This Florida Senior Living Association's Administrative Rule Review reports on recently proposed regulatory changes affecting Florida’s ALFs as a service to FSLA members.

QUICK REVIEW: On July 3, 2023, AHCA published Emergency Rules 59AER23-1 and 59AER23-2, which implement requirements from SB 252, Protection from Discrimination Based on Health Care Choices.

The bill, in part, creates s. 408.824, F.S., and requires ALFs, in addition to establishing facial covering policies and procedures by August 1, 2023, but to also make sure the policies are accessible from either: (1) the ALFs website, or: (2) conspicuously displayed in its lobby.

Please also make sure to double-check (and update as needed) your visitation policy required by SB 988 (2023), which requires ALF visitation policies to address the ALFs visitor infection control policies and procedures, including personal protective equipment. The bill requires these policies and procedures to be easily accessible from ALF's homepage website.
